A sad update to my August 6, 2012 post, Over $45,000 raised to help Texas family STOP TransCanada from seizing their farm for pipeline. The greedy scoundrels took advantage of a legal loophole to seize private land. According to a New York Times’ report:

The case has shed light on a loophole in Texas’s oil and gas regulation — one that critics say has given pipeline companies carte blanche to seize private land. Activists across the political spectrum have rallied behind Ms. Crawford’s cause, from conservative rural landowners and Tea Party organizations to environmental groups. At issue was whether TransCanada is a common carrier — a company with pipeline open to any oil company willing to pay published rates. In Texas, a common carrier has the power to condemn land with little oversight.

Jane Kleeb, executive director for BOLD Nebraska, released the following statement in response to a Lamar County, Texas judge ruling against landowner Julia Trigg Crawford and in favor of oil giant TransCanada in Crawford’s eminent domain case to halt the construction of the Keystone XL tar sands pipeline through her private property:

“The fact that a foreign company can claim rights to American private property without having to prove that it is a Common Carrier or prove that a single drop of the oil will remain in America is an affront to landowners’ liberties. TransCanada has used its financial and legal resources to bully landowners like Julia Trigg Crawford in order to clear the way for their multi-billion dollar tar sands pipeline.

Throughout the process, landowners have been cast aside and their concerns about land and water ignored. Judge Bill Harris went so far as to dismiss Ms. Crawford’s entire case with a 15 word ruling sent from his iPhone—an action that speaks to the appalling ways ranchers, stewards of the land, have been treated in this fight.



Despite these serious environmental concerns about infringement on property rights, the GOP is insistent that this tar sands pipeline be built immediately. In fact, presumptive nominee Mitt Romney has said “I will build that pipeline if I have to myself.”

Republicans ignore commitment to property rights in favor of Big Oil

As we approach the RNC in Tampa this weekend, it is important to note that the 2008 Republican Platform took a firm stand on eminent domain in regards to the recent Kelo decision. The platform called ‘on state legislatures to moot the Kelo decision by appropriate legislation,’ and further pledged, ‘on the federal level to pass legislation to protect against unjust federal takings.’

Landowners like Julia Trigg Crawford from all along the Keystone XL pipeline route have been doing everything in their power to keep TransCanada off their property, but the GOP is now ignoring its commitment to property rights in favor of giving Big Oil a free pass.

Wow! We raised over $45,000 to help Julia Trigg Crawford take on Big Oil’s lawyers and PR consultants who are trying to seize her farm to build the Keystone XL pipeline. Her critical pre-trial hearing starts this Friday, and we want to send her a giant Good Luck card to remind her that we’ve got her back.

We are totally blown away. We set what we thought was an ambitious goal — to raise $25,000 — to help Julia Trigg Crawford go head-to-head with TransCanada’s high-priced lawyers and PR consultants. The Keystone XL pipeline will pump tar sands, some of the world’s dirtiest fuel, to refineries and ports in Texas where it will be loaded into tankers and shipped to foreign markets. But Julia Trigg’s family farm lies directly in the pipeline’s path. That’s why TransCanada, the company building it, is fighting desperately to seize part of her land through a legal process called “eminent domain.” Many SumOfUs members, including Julia Trigg, have been campaigning against the pipeline for years. This case is a huge opportunity to delay or even block the pipeline.

Julia’s pre-trial starts on Friday, and her trial begins in late August. The legal battle could go on for months or even years — but Julia, her family, and her people-powered team are in this fight for the long haul, and every day that she’s fighting is a day the pipeline isn’t being built.

Julia Trigg Crawford is a farmer and mother living in rural Texas. She spends her days working on her 600 acre farm, a farm where her grandfather grew alfalfa, peanuts, maize and cotton. It’s one of those rare places where you can still see a majestic sea of stars shimmering at night. Chances are you’ve never met or heard her name before, but she could be the key to stopping the Keystone XL pipeline for good.

When TransCanada showed up on her father’s doorstep in 2008 telling him they were going to build the Keystone XL pipeline through their land, Julia Trigg’s family knew they had to fight back. And so now, they’re doing what anyone committed to protecting their children, their grandchildren, their land, and the climate would do — they’re taking TransCanada to court.

TransCanada claims they have the legal right to her family’s land, and have hired the high-priced lawyers and PR consultants to prove it. Julia Trigg has a strong case, and a committed team powered by folks like you–regular citizens from around the world who are willing to help a stranger. Last year, she was arrested along with actor Daryl Hannah and documentary filmmaker Josh Fox at the White House in the largest single act of civil disobedience in U.S. history. Like the hundreds of people who were arrested with her, she knows that the Keystone XL pipeline will not create the jobs that our communities desperately need right now. And she knows that a spill of tar sands bitumen crude would mean game over for communities like hers because the diluted bitumen is heavier, more corrosive and contains more toxic chemicals than conventional crude. And what’s worse, TransCanada’s spill record is abysmal — the Keystone XL’s sister pipeline, the Keystone pipeline, spilled twelve times in its first year in operation. It’s not a question of if the Keystone XL pipeline will spill, but when.

And now, the pipeline battle is heating up. TransCanada was just granted one of three permits it needs to build the $2.3 billion southern section of the pipeline. And that permit runs right through Julia Trigg’s farm. But she won’t hand her land over to TransCanada — and she’s not going down without a fight.

Obama rejected the pipeline once before, but this time around, TransCanada is trying to force the pipeline through in stages to make sure it gets built. The company only needs a few other permits, and the decision on one is expected any day. TransCanada is ready to start construction on the pipeline any day, and that’s why we need to fight back now.
